Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Mediterra Digital Business Cards platform (the "Service") operated by Mediterra Datacenters S.r.l. ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Description of Service

Mediterra Digital Business Cards is a platform that allows users to create, manage, and share digital business cards. The Service provides:

  • Creation and customization of digital business cards
  • QR code generation for easy sharing
  • Analytics and tracking of card views and interactions
  • Integration with mobile wallet applications (Apple Wallet, Google Wallet)
  • Profile management and contact information storage

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding the password and for all activities that occur under your account. You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

4. User Content

4.1 Content Ownership

You retain ownership of any content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such User Content for the purpose of providing and improving the Service.

4.2 Content Responsibility

You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that:

  • You own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use your User Content
  • Your User Content does not violate any third-party rights, including intellectual property rights, privacy rights, or publicity rights
  • Your User Content does not contain any unlawful, harmful, threatening, abusive, or otherwise objectionable material

4.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable in our sole discretion.

5. Acceptable Use

You agree not to use the Service:

  • In any way that violates any applicable national or international law or regulation
  • To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
  • To impersonate or attempt to impersonate the company, a company employee, another user, or any other person or entity
  • In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service
  • To introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Mediterra Datacenters S.r.l. and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Service Availability

We reserve the right to withdraw or amend the Service, and any service or material we provide through the Service, in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the Service is unavailable at any time or for any period.

In no event shall Mediterra Datacenters S.r.l., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

10. Indemnification

You agree to defend, indemnify, and hold harmless Mediterra Datacenters S.r.l. and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

12. Governing Law

These Terms shall be interpreted and governed by the laws of Italy, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
